Is it possible to remove the check for existing name in the user list?

Because I think the names in the user list on the website cannot be used as a name for the comments, but these names are generic and can be used by anyone because it is just the first name. Can I remove this chek?

This is unfortunately not possible. If a user has registered a name then no one apart from him can comment with that name.
